Federal Skilled Workers Program (Canada PR)

Canada Federal skilled workers is a program designed by the government to provide permanent settlement option for people on the basis of their abilities and skills. It is a point based visa which requires you to pocket at least 67 points to qualify. The points can be claimed based on the following parameters:-

1) Education
          University degree at the Doctoral (PhD) level or equal- 25 points
                University degree at the Master’s level or equal -23 points
          University level entry-to-practice professional degree . Occupation related to the degree must  be:-
                NOC 2011 Skill Level A, an licensed by a provincial regulatory body (Degree must be secured in Veterinary Medicine, Dentistry,     Podiatry, Medicine, Dentistry, Podiatry, Optometry, Law, Chiropractic Medicine, or Pharmacy) 23 points


           Two or more Canadian post-secondary degrees or diplomas or equal (at least one must be for a program of at least three years)-22 points
            Canadian post-secondary degree or diploma for a program of three years or longer, or equal- 21 points
            Canadian post-secondary degree or diploma for a two-year program, or equal-19 points


            Canadian post-secondary degree or diploma for a one-year program, or equal-15 points
            Canadian high school diploma, or equal-5 points

c) International graduate who has enrolled himself/herself in the PHD program in Canada and
2) Should meet the minimum English requirement of Canadian Language Benchmark (CLB) 7.
3) Can claim additional points by Test d’evaluation de francais(French exam test)
4) Have Canadian Diploma ,Bachelor , trade certificate or Foreign Qualification assessed by Educational Credential Assessment (ECA) by an agency approved by CIC to provide evidence to Canadian qualification.

Starting from May 2013 Canadian government has introduced a process of going through the Educational Credential Assessment (ECA) where foreign degrees,diplomas certificates etc are compared with the Canadian credentials to check their equivalence before applying for Federal Skilled worker visa.
Every person who is a primary applicant and has completed their education outside Canada has to undergo Educational Credential Assessment (ECA) before lodging the final visa application
There are four bodies which have been approved by government of Canada to conduct Educational Credential Assessment (ECA).They are:-

Trades Program(FSTP)
The Federal Skilled Trades Program is for the applicants who are qualified trade workers and want to migrate to Canada permanently after receiving a offer of employment.
The government approves only 3000 applications each year under this visa category where no more than 100 applications for a particular occupation is considered for processing each year for Category A while there is no cap on Category B.

To be eligible to apply as skilled worker the aspirant should:-
1) Plan to live in any state except Quebec.
2) Meets minimum language requirement of (CLB) 5 for speaking and listening, and CLB 4 for reading and writing.
3) Have at least 2 years of full time working experience in the nominated occupation in the past 5 years before applying.
4) Should perform all the duties mentioned for the nominated occupation in National Occupational Classification (NOC)
5) Have an offer of full-time employment for a total period of at least one year or a certificate of qualification in that skilled trade issued by a provincial or territorial body.

Age
Should not be less than 17 years
Language Skills
1) Have English skills of not less than CLB 5
2) To claim points for french threshold level for learning is level 7 (advanced intermediate) of the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent (level B2 of the Common European Framework of Reference for Languages) is
Stay and relationship with Canadian citizen and quebec residents.

1) Number of children less than 22 years migrating to quebec alongwith.

Family and spouse

1) Above 18 years of age
2) Be Canadian citizen or Permanent resident
3) Be able to support the sponsored family members financially in their initial stay period and the duration of support  varies from 3 to 10 years depending upon the relationship that you hold with the family member.
Note: If you have sponsored any person in the past who has asked government for financial support after coming to Canada ,you may not be able to sponsor any other person
Elgibilty of Spouse:-
1)Should be above 18 years of age
2)Should be legally married or in a common law relationship.
3)Should have a marriage certificate issued by the state,territory or provincial government if the marriage has taken place in  Canada.
4)  If the marriage has  taken place outside Canada then it should be valid as per the country law where the ceremony has taken place and the Canadian  law. .However If the marriage ceremony has taken place in  the embassy or Consulate then it should be valid as per the law of the country where ceremony has conducted  rather than the country represented by Embassy Or Consulate.
5) Should not have any Criminal convictions ,offences   or suffer from any critical health condition..
Elgibilty of Dependent Child. 
1) Should be less  than 22 yrs age and don’t have any spouse and common law partner.
2) Over 22 years of Age but should satisfied either of two conditions Mention below
a.     Should be engaged full time ongoing study
b.     Should be financially dependent on parents since before 22 yrs of age
3) If a child has a spouse or common law partner before turning 22 then he should :-
a.     Should be engaged full time ongoing study
b.     Should be financially dependent on parents since they become spouse and common law partner.
4) If the child is over 22 yrs of Age he should be financially dependent on parents due to physical or mental conditions.
Elgibilty of other sponsored relative
 You can sponsor:
         brothers or sisters, nephews or nieces, granddaughters or grandsons who are orphaned, under 18 years of age and not married or in a common-law relationship
         another relative of any age or relationship but only under specific conditions (see Note below)
         accompanying relatives of the above (for example, spouse, partner and dependent children).
Note: You can sponsor one relative regardless of age or relationship only if you do not have a living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and you do not have any relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act.
As of November 5, 2011, no new applications to sponsor parents or grandparents will be accepted for processing for up to 24 months.

4.     Should have at least 6 months classroom training in  early childhood education, geriatric care, paediatric nursing or first aid or 1 year full time working experience as a caregiver in past 3 years.
5.     Have good understanding of English and French to communicate and read.

Parents and Grandparent Visa
 Parents and Grandparents super visa makes your parents to get Parents or Grandparents of people living in Canada as Canadian citizens or Permanent residents can visit them to meet and spend quality time on this visa which is called Super Visa. The visa is valid for 10 years and the applicant can stay for a period of 2 years each time without renewing the Visa within the span o 10 years.

Start Up Visa

Start up visa is at business programme which has been designed by Government of Canada to allow immigrant entrepreneurs to set up a business in the country with the help of experienced private sector organizations that have expertise in working with start-ups
This Visa helps you to get business idea funded and migrate to Canada permanently
Eligibility for Applying
1) Should have business idea that is convincible enough to get a letter of support from designated angel investor group or venture capital fund. You must secure a minimum investment of $200,000 if the investment comes from a designated Canadian venture capital fund
2) Meet the minimum level of CLB 5 in either English or French for all four language abilities.
3) Should have completed at least one year of post-secondary education
and prove that you were in good standing during at least one year while you were attending a post secondary institution.
4) Should have sufficient fund to support yourself and family initially after arriving in Canada.

Self Employed Visa is a program for the applicants who are engaged into cultural activities, athletics at world class level or buying and managing a farm and want to migrate to Canada as self employed.
To be eligible as a self employed applicant should
1)     Have at least 2 years of experience in the past 5 years before the date of applying in one of the following categories:-
         Cultural activities
         Athletics at world class level or
         Buying and managing a farm.
 2)    Meet the point based criteria based on the following factors:-

As an international student you can work in Campus if:-
         You are registered as full time student in  a public post-secondary institution, such as a college or university, or a CEGEP in Quebec
         You are registered as full time student in any Canadian private institution that run under the same rules and regulations and receive 50 % of finances from government authorities or their operations.
         You are registered as full time student in Canadian private institution authorized by provincial statute to confer degrees.
         You must have valid work permit.

Off Campus Jobs:-
As an international student you can work outside the Campus if:-
         You have valid student permit.
         You study at participating institutions as not all institutions allow you to work off campus.
         You have acquired satisfactory grade in the program being studied.
         Sign a form authorizing the institution, the province, and Citizenship and Immigration Canada (CIC) to share your personal information
         You have studied full time for 6 months in last 12 months preceding the work permit application
         You are registered as full time student in participating publicly funded post-secondary educational institution or in an approved program at an eligible privately funded institution.
         You must have applied and received student work permit
         You work not more than 20 hours per week during the academic session and full time in breaks.
 Co–op student or intern:-
In some Academic programs work experience is a part of curriculum.To participate in such programs you should meet the following conditions :-
         Have a valid study permit and intended employment must be an essential part of your program of study in Canada.
o    Your employment must be part of your academic program, certified by a letter from a responsible academic official of the institution.
o    Your co-op or internship employment cannot form more than 50% (percent) of the total program of study.
Work in Canada after Graduation:-
There are many options to stay and gain valuable Canadian experience after completion of your course and later you can even apply for Permanent Residency if you fulfil the criteria.
If you have graduated from:-
         A public post-secondary institution, such as a college, trade/technical school, university or CEGEP (in Quebec), or
         A private post-secondary institution that operates under the same rules and regulations as public institutions, or
         A private secondary or post-secondary institution (in Quebec) offering qualifying programs of 900 hours or longer leading to a diplôme d’études professionnelles (DEP) or an attestation de spécialisation professionnelle (ASP), or
         A Canadian private institution authorized by provincial statute to confer degrees but only if you are enrolled in one of the programs of study leading to a degree as authorized by the province and not in all programs of study offered by the private institution.
You can apply for post study work permit within 90 days of getting your transcript of passing the course and received notification from the institute that after meeting all the requirements you are now eligible to get the Degree/Diploma/Certificate
Note:-You can get the work permit of the duration equal to your course of study but maximum of 3 years.
Spouse or Common law partner work permit
You can help your Spouse or Common law partner to work in Canada if:-
         You are registered as full time student in  a public post-secondary institution, such as a college or university, or a CEGEP in Quebec

Work Permit(LMO Based)


Every year thousands of people go to Canada to work there temporarily on work permit. To be able to work in Canada temporarily the visa applicant must hold an offer of employment or employment contract from a Canadian employer and a positive LMO from Human Resources and Skills Development Canada (HRSDC).However some jobs do not require LMOs
Basic requirement to be able to Apply for work permit visa the visa aspirant must:-
1) Have an employment contract from a Canadian Employer.
2) A positive LMO from Human Resources and Skills Development Canada (HRSDC) for which the employer lodges an application to HRSDC demonstrating the need for the foreign employer and their failure to locate any local Canadian citizen or permanent resident for the nominated job. If the HRSDC gets satisfied they issue a positive LMO to proceed.
3) Satisfy the immigration officer that you will leave the country once your employment ends.
4) Should prove that you are financially strong to support yourself and family if they are staying along with you and would not be requiring any financial support by the government of Canada.
5) Obey all Canadian laws and do not have any criminal convictions or offences
6) Not hold any critical medical conditions.
7) Not have worked in Canada for one or more periods totalling four years after April 1, 2011, (with certain exceptions)
Privileges:-
Work permit visa:-
1) Allows you to call your family to stay with you and your family members can study and work in Canada.
2) Allows you to stay in Canada for 4 years in Canada.
3) Being on Work permit you can apply or permanent residency.

If you are currently working or plan to work in Canada, you should keep track of the total time you have worked and plan to work in Canada. Once you have completed four years of work as a temporary foreign worker in Canada, you will not be eligible to work in Canada again until another period of four years has passed

Processing time depends on the nationality of the applicant and country where applying and varies anywhere between 2 to 7 months.
